The laws around GDPR do not have to be complicated, but they seem misused and misunderstood by many companies. Large companies have come under fire recently for not adhering to European laws. So, let's chat about it. 

GDPR is not just a rulebook anymore; it's changing the foundations of how we do B2B sales. Think of it as nudging businesses to focus on being open and honest with data, which builds better relationships with clients anyway. It's not just about avoiding trouble; it's about building trust that lasts. 

Individuals in 2025 are clued up about their data. They want to know it's in good hands, and they know their rights. GDPR's raised the bar, especially for sales and marketing, and that's good. It allows all businesses to show that they're serious about privacy. Funnily enough, you may still get phone calls from companies you have never heard of and have never spoken to, but this is still GDPR-compliant business practice.  

So Let's Break it Down

Unlike B2C marketing, where explicit opt-in consent is typically required, B2B sales outreach can sometimes rely on "legitimate interest." This means businesses can contact professionals at their business email addresses without prior opt-in, provided: 

The message is relevant to the recipient's role 
The outreach is not intrusive or excessive 
The recipient has a clear opt-out option  

However, some EU countries impose stricter B2B rules. For example: 

  • Germany & Austria – Require opt-in for cold B2B outreach 
  • UK & France – Allow opt-out under legitimate interest 

But what does this mean in business terms?  

Opt-in means you (the business) require explicit prior consent before sending marketing messages (standard in B2C, varies in B2B)  

Opt-out means you (the business) can send messages under legitimate interest, provided the recipients can unsubscribe easily. Recipients should be able to request deletion of data through a button (generally at the footer of an email) or verbally over the phone.  

Below is a breakdown of the European countries that have imposed the opt-out, single opt-in and double opt-in practices.

GDPR ensures that LinkedIn messages, WhatsApp outreach, and email sales are non-intrusive and compliant. Businesses must be cautious about how they collect and use data for outreach. 

The Core Principles of Legitimate Interest Under GDPR 

Businesses relying on legitimate interest must satisfy a three-part test: 

  1. Purpose Test: The business must have an explicit and lawful reason for processing personal data (e.g., direct marketing, fraud prevention, network security). 
  1. Necessity Test: Data processing must be essential for achieving the business goal and should be minimised where possible. 
  1. Balancing Test: The recipient's rights and freedoms must not be overridden by the business's interest. If the marketing is too intrusive, legitimate interest does not apply. 

💡 Key GDPR Rule: Individuals have the absolute right to object to direct marketing, and businesses must stop processing their data if requested. 

Staying compliant during your B2B outreach:

LinkedIn Outreach

Personalise connection requests to increase engagement 
Avoid scraping personal data for mass outreach 
Provide an easy opt-out for unwanted communication 

🚨 Caution: Sending mass automated messages or using scraped LinkedIn data violates GDPR and LinkedIn's policies. 

Whatsapp Sales Outreach

Obtain explicit consent before sending messages 
Be transparent about message purpose & frequency 
Include an easy opt-out, like replying "STOP." 
Use WhatsApp Business API for compliance 

🚨 Caution: WhatsApp is a personal communication channel, and cold outreach without consent may violate GDPR. 

B2B Email Marketing

Use a soft opt-in for existing customers 
Provide a visible unsubscribe link in every email 
Generate email list from GDPR-compliant vendors.   

Keep records of consent & opt-out preferences 

🚨 Caution: Email marketing rules vary by country, with stricter rules in places like Germany and Austria. 

B2B Cold Calling

Screen against "do not call" lists in each country 
Train sales teams on GDPR compliance 
Clearly state identity & purpose at the start of the call 
Respect objections & do not call again
